The case, Re K-H (Children) [2015] EWCA Civ 543, in which Coram Children's Legal Centre intervened with the Association of Lawyers for Children, was an appeal brought by the Lord Chancellor against an earlier decision.
What was the case about?
The case related to proceedings in the family court, which concerned arrangements for the father to spend time and have contact with his children K and H, who were aged 4 and 5. The mother's older daughter Y (who was 17) alleged that she had been sexually abused by the father. There was to be a fact-finding hearing for the court to determine the truth of the allegations and what impact, if any, this would have on the application before the court regarding care arrangements for K and H. The court determined that Y should give live evidence to the court.
