Legal Update: Court anonymity for young people

Kirsten Anderson, legal research and policy manager at Coram Children's Legal Centre discusses a ruling that children previously involved in court proceedings can be named in the media after they turn 18.

The case, JC & RT v CPS & BBC, raised the issue of whether an order made under Section 39 of the Children and Young Persons Act 1933 prohibiting the identification of a defendant under the age of 18 years, can last indefinitely or whether it automatically expires when the person reaches the age of 18. Section 39 provides: "In relation to any proceedings in any court, the court may direct that (a) no newspaper report of the proceedings shall reveal the name, address or school, or include any particulars calculated to lead to the identification of any child or young person concerned in the proceedings; and (b) no picture shall be published in any newspaper as being or including a picture of any child or young person so concerned in the proceedings."
