Law milestone for abuse victims

A three-year limit on child abuse victims seeking damages from institutions for negligence could be a thing of the past after a ruling by the Law Lords.

In a judgement on five cases that has set a new legal precedent, the Law Lords decided it was up to judges to decide whether a claim for damages can be made years after abuse has taken place.

Until now any claim against a local authority or institution on grounds of negligence in failing to prevent child abuse had to be made within three years from the date of the abuse or the injury becoming known.

David Keegan, director of High Cost Cases Group at the Legal Services Commission, which paid for four of the five cases, said: "This is a milestone for victims of abuse."
