In 2006, a social worker working for the youth offending service had written a report stating that the appellant, then aged 16, was a child in need and required housing. The appellant then presented this report to the housing department and was provided with accommodation under section 188 of the Housing Act 1996.
The local authority argued that, as the appellant had been provided with accommodation by the housing department rather than children's services, he was not entitled to leaving care support on reaching 18 years of age. The appellant sought a declaration of his status as a "former relevant child" under section 23C of the Children Act 1989.
