The claimant in this case was an asylum seeker from Iran.

He claimed that he was born on 24 March 1994 and as such was aged 14 at the time of his first age assessment in 2008.

The defendant local authority disagreed and concluded that the claimant was born on 24 March 1992, making him 16 years old when first assessed.

Assessment guidelines

The local authority assessed the claimant in accordance with guidelines set out by the High Court in the case of Merton. These require that the assessment includes consideration of the applicant's family circumstances and history, his educational background and any activities undertaken in the years preceding assessment.
