Court fees reform for care proceedings

A consultation paper on fees for care proceedings is considering options for an overhaul of the current structure.

Is it true they're trying to reduce the number of child care cases going to court by upping the cost?

Child care proceedings have the lowest fee-to-cost recovery ratio of any civil or family court business. In 2006/07, the difference between the fees paid for public law Children Act 1989 proceedings and the cost to the court system was estimated at about £35m. In a current consultation paper, the government proposes to re-configure the way cases are paid for by raising court fees to cover full costs, reducing the grant given to Her Majesty's Court Service (HMCS) and putting more money into the spending settlement for local authorities.
