Consultation on Draft Regulations, and Associated Statutory Guidance, for Local Authorities to Provide Short Breaks for Carers of Disabled Children and Young People

This consultation looks at draft regulations that require local authorities in England to provide services to parents and carers of disabled children and young people that give them short breaks from their caring responsibilities.

It is intended that these regulations will enable parents and carers to continue to provide day-to-day care for their children and will do this more effectively as a result of the short break allocation.

The consultation will also look at draft statutory guidance for local authorities to help them understand their legal duty to provide short breaks, the range of breaks required and who is eligible for them. The regulations are underpinned by the Children and Young Persons Act 2008, which introduced a new statutory duty on local authorities to give those who care for disabled children and young people a break from their responsibilities.
