The Antisocial Behaviour Act 2003 contains a clause that allows the Home Secretary to lower the age limit for the penalty notices. To enact this clause, the Government needs to ask the House of Commons and the House of Lords to back the plan, but it could be approved relatively quickly.
A Home Office spokesman confirmed the Government is working on a penalty notice scheme for under-16s. He said the scheme would be extensively piloted to make sure it worked, but added that details such as the value of the fines were being discussed with stakeholders, including the Youth Justice Board and the Association of Chief Police Officers.
