The 2009 Apprenticeships, Skills, Children and Learning Act made local authorities responsible for organising young offender education from September 2010. The move was intended to improve radically the quality and consistency of education that young offenders receive.
But after the general election, the government decided to put these duties on hold.
On 29 July 2010, a letter from schools minister Nick Gibb and junior justice minister Crispin Blunt, announced: "It is important that we get this right. We have therefore taken the decision to delay the commencement of the legislation to 1 April 2011."
But the delay order never took place because of an internal mistake. In a letter to the Local Government Association (LGA) sent last week and seen by CYP Now, the two ministers explained the blunder, saying: "Due to administrative error, these provisions did in fact come into effect on 1 September this year."
