Legal action threat over sending clinically vulnerable children back to school

Lawyers working on behalf of The Good Law Project (GLP) have written to the Education Secretary calling for guidance around children’s return to school to be amended to protect disabled children, those classed as clinically vulnerable and those living with a clinically vulnerable person.

The letter states lawyers are “concerned” that current government guidance means parents of vulnerable children and those with vulnerable family members can no longer cite Covid-19 worries as a reason to keep their child off school unless they have tested positive for the virus.

It adds that parents now face “an impossible choice” between children catching the virus or being issued with a “fine, prosecution or conviction” due to their child’s unauthorised absence.
