The government had banned the drug mephedrone after police linked it with the two boys' deaths. But it is understood that toxicology tests show that they had not even taken the drug.
UK drug policy commission member Professor Colin Blakemore called the ban "a fiasco" and called for a "long overdue review of drug control policy."
The commission is now carrying its own 18-month review into how drug policy should best be handled.
The ban on methedrone by the previous government sparked outrage among many drug experts. Two members of the government's drug control advisory group, the Advisory Council for the Misuse of Drugs, quit over the matter.
Roger Howard, chief executive of the UK Drug Policy Commission, added: "We believe the new Government has an opportunity to both better protect the public and save money by reshaping the architecture for decision making.
"Getting the governance right will lead to better outcomes for every community in Britain, and rebuild trust between experts and politicians."
