Mr Justice Pitchford ruled that an inquiry chaired by Brian Payling would not be "sufficiently independent" after the Howard League for Penal Reform challenged the appointment of the retired senior Prison Service manager.
Payling is chair of the SP public inquiry, which is investigating the treatment of a teenage girl in custody between 2003 and 2005. The young woman, known as SP, attempted self-harm and suicide while in custody but was placed in solitary confinement. She has been represented by the Howard League for Penal Reform for five years.
Payling replaced Prisons and Probation Ombudsman Stephen Shaw as chair of the inquiry after he resigned in June 2008.
